Terms of Use

These Terms of Use ("Terms") are an agreement between you and Lingible LLP, a limited liability partnership registered in the Republic of Kazakhstan ("Lingible", "we", "us"). They govern your use of the Lingible app (the "App") and related services. By downloading, installing or using the App, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your country, you may use the App only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.

2. The Service

Lingible is an e-book reader for language learners. Depending on your plan, it includes:

• Reading your own e-books (EPUB, FB2, PDF, TXT, DOCX, MOBI and other formats), which are converted on our server
• Word and passage translation, parallel translation and read-aloud
• AI-powered explanations, grammar help, AI chat and flashcard generation
• Saved words, flashcards with spaced repetition and notes
• A library of public-domain books
• Learning videos with dual subtitles
• Cloud library and sync across devices for signed-in users
• Reading statistics and reminders

We continuously improve the App and may add, change or remove features. If we remove a feature that is a material part of a paid subscription, we will tell you in advance.

3. Your Account

Some features require signing in with Google or Apple. You are responsible for activity under your account and for keeping access to your Google or Apple account secure. Tell us immediately if you suspect unauthorized use.

You can delete your account at any time in the App or by email, as described on the Delete Your Account page. Deleting your account does not cancel an active subscription; cancel it in the App Store or Google Play.

4. Subscriptions and Payments

4.1 Plans

The App offers a free plan with limits and paid subscriptions that unlock premium features. The price, billing period and included features are shown in the App before you buy. Limits of the free plan may change over time.

4.2 Billing and Automatic Renewal

Payment is charged to your Apple ID or Google Play account when you confirm the purchase. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price of your plan. You can manage and cancel your subscription in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.

4.3 Free Trials

If a plan includes a free trial, you will be charged when the trial ends unless you cancel at least 24 hours before it ends. Any unused part of a free trial is forfeited when you buy a subscription. Free trials are limited to one per user.

4.4 Refunds

Purchases are processed by Apple or Google, and refunds are handled under their refund policies. Nothing in these Terms limits the rights you have as a consumer under the laws of your country, including any statutory right of withdrawal.

4.5 Price Changes

We may change subscription prices. Changes are notified in advance through the App Store or Google Play in accordance with their rules, and do not apply to a billing period you have already paid for. If you do not agree, you can cancel before the new price applies.

5. Your Content

You keep all rights to the books, notes and other content you add to the App ("Your Content"). You grant us a limited, non-exclusive, worldwide, royalty-free license to store, convert, process and transmit Your Content only as needed to provide the App to you, including sending selected text to translation, speech and AI providers at your request. This license ends when you delete Your Content or your account, except for copies we must keep by law.

You confirm that you have the right to use the content you upload and that it does not infringe anyone's rights or break the law. Your cloud library is for your personal use; do not use the App to distribute or publish content. We do not review Your Content, but we may remove content that we reasonably believe violates these Terms or the law.

6. Copyright Complaints

If you believe content in the App infringes your copyright, email lingible.app@gmail.com with the subject "Copyright complaint" and include:

• A description of the copyrighted work
• Where the content appears in the App (for example, the book title in our library)
• Your name and contact details
• A statement that you believe in good faith that the use is not authorized by the copyright owner or the law
• A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

We will review the complaint promptly, remove or disable access to infringing content, and may terminate the accounts of repeat infringers.

7. AI Features, Translations and Read-Aloud

Translations, AI answers and synthesized speech are produced automatically by us and third-party providers (such as OpenAI, Google, Microsoft and DeepL). They may be inaccurate, incomplete or inappropriate, and they are not professional advice. Check important information yourself. Do not submit sensitive personal information to AI features, and do not use them to generate unlawful or harmful content.

8. Third-Party Services and Content

• YouTube. Videos are provided through YouTube API Services. By using the video features, you agree to be bound by the YouTube Terms of Service; see also the Google Privacy Policy.
• Public-domain library. Books in our library come from sources such as Project Gutenberg and are believed to be in the public domain in the United States. Copyright laws differ between countries; check whether a work is in the public domain where you live before using it outside the App.
• Other services. The App relies on third-party services (such as Google, Apple, RevenueCat, OpenAI, Microsoft and DeepL). Their availability is not under our control, and your use of them may be subject to their own terms.

9. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or upload content that infringes others' rights
• Copy, sell, rent, sublicense or distribute the App
• Reverse engineer, decompile or modify the App, except where the law allows it
• Bypass subscription checks, usage limits or security measures
• Use bots, scrapers or automated means to access the App or our servers
• Overload, disrupt or attempt unauthorized access to our servers or other users' data

10. Our Intellectual Property and License

The App, its software, design, text, graphics and the Lingible name and logo belong to Lingible or its licensors. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control for non-commercial purposes. All rights not expressly granted are reserved.

11. Disclaimers

To the extent permitted by law, the App is provided "as is" and "as available". We do not guarantee that the App will be uninterrupted or error-free, or that translations, AI answers or learning results will meet your expectations. If you are a consumer, this does not affect your statutory rights, including legal guarantees of conformity for digital content and services in your country.

12. Limitation of Liability

To the maximum extent permitted by law, Lingible is not liable for indirect, incidental, special or consequential damages, loss of profits or loss of data arising from your use of the App. Our total liability for all claims relating to the App is limited to the greater of the amount you paid us in the 12 months before the claim or USD 100.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or intentional misconduct, or any other liability that cannot be excluded or limited under applicable law.

13. Indemnification

To the extent permitted by law, you agree to compensate Lingible for claims, losses and reasonable costs arising from Your Content or your violation of these Terms or of the rights of others.

14. Suspension and Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you seriously or repeatedly violate these Terms or the law, or if required by law. Where reasonable, we will notify you and give you a chance to respond. Sections that by their nature should survive termination (such as Sections 5, 10, 12, 13 and 16) remain in effect.

15. Changes to These Terms

We may update these Terms. For material changes, we will notify you in the App at least 30 days before they take effect. If you do not agree with the changes, you can stop using the App and cancel your subscription before they take effect. Continuing to use the App after that date means you accept the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict of law rules. Disputes are resolved by the competent courts of the Republic of Kazakhstan.

If you are a consumer living in the European Union, the European Economic Area, the United Kingdom or another country with mandatory consumer protection laws, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.

Before starting any formal proceedings, please contact us at lingible.app@gmail.com; we will try to resolve the issue within 30 days.

17. Additional Terms for the Apple App Store

If you downloaded the App from the Apple App Store, the following terms also apply:

• These Terms are between you and Lingible only, not Apple. Lingible, not Apple, is solely responsible for the App and its content.
• Your license to use the App is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing.
• Lingible is solely responsible for maintenance and support of the App. Apple has no obligation to provide any maintenance or support services.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Lingible, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
• If a third party claims that the App or your possession and use of it infringes their intellectual property rights, Lingible, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms of agreement when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

18. Google Play

If you downloaded the App from Google Play, your purchases are also subject to the Google Play Terms of Service.

19. General Provisions

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Lingible about the App and replace the earlier User Agreement.
• Severability. If any provision is found invalid, the remaining provisions stay in effect.
• No waiver. Our failure to enforce a provision is not a waiver of it.
• Assignment. You may not transfer these Terms without our consent. We may transfer them to a successor of our business, provided your rights are not reduced.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
• Language. If these Terms are translated, the English version prevails to the extent permitted by law.
